Charles Leach’s estate is suing Tesla. They claim his Model Y automobile “suddenly” accelerated, drove off the road and struck a pillar at an Ohio gas station. Leach was 72 when he died of burns, blunt force trauma, and other injuries. His estate claims the company was aware their vehicles, including the Model Y, have had hundreds of instances of uncontrolled acceleration which, in this case, led to Leach’s death. The company blames his alleged “improper and unsafe” driving and claims his vehicle wasn’t dangerous or defective.
- Utility’s Alleged Role in Fatal Fire
A wrongful death lawsuit is pending against Southern California Edison for its alleged negligent actions regarding Los Angeles’ Eaton Fire. The legal claim on behalf of Evelyn McClendon’s family was announced in January. The Altadena woman is one of at least 16 who were killed in the fire that started on January 7. The lawsuit claims the utility negligently failed to turn off its electrical equipment after receiving warnings about dangerous fire weather conditions.
- Restaurant Allegedly Served Contaminated Food to Customer
Jeffrey Piccolo represents the estate of his late wife, Kanokporn Tangsuan. She was a New York doctor who died of an allergic reaction to food eaten at a Disney-owned restaurant in Orlando, Florida, in October. Tangsuan was “highly allergic” to nuts and dairy. Piccolo states they chose the restaurant in part because it promises to accommodate patrons with food allergies, according to Piccolo’s wrongful death lawsuit filed in a Florida circuit court. He claims they had repeated conversations with their waiter about Tangsuan’s allergies. The family asked about the safety of the menu items, had the server confirm with the chef that they would be allergen-free, and asked for confirmation several more times. When food came to the table, some items lacked flags stating they were allergen-free, and the waiter was questioned again about the issue. He stated the food was allergen-free. About 45 minutes after leaving the restaurant, Tangsuan had difficulty breathing and later died.
